SELF DRIVE HIRE TERMS & CONDITIONS

 

Walk On Equine Transport, Self Drive Hire & Horseboxes. These terms shall apply to you the “hirer” of the horsebox. 

Walk On Equine Transport, Self Drive Hire & Horseboxes (referred to as Walk On for the purpose of this document) provide a service to its hirer to enable the use of its horsebox (referred to as vehicles for the purpose of this document). Walk On will alter or change these terms and conditions without notice, from time to time. 

Walk On will provide the hirer with the following:


– Comprehensive vehicle insurance for the period of hire
– A full tank of fuel upon hire of the vehicle (which is to be returned full)
– Full instruction on how to operate the vehicle 
– A detailed inspection, detailing the condition of the vehicle prior to hire. We will ask you to do a detailed walk around video of any damages before taking the vehicle & once returned.
– 24hr roadside recovery with Equine Rescue. Contact details will be given. 
– A vehicle fitted with a tracking device, alarm, cameras inside the stalls and outside automatic reverse cameras
– Use of parking facilities for one (1) car, however the hirer accepts all risks, liabilities, and responsibility for the vehicle whilst parked. 

 

The hirer

  • ‘The Hirer’ (individual/s and / or companies wishing to hire the horse box supplied by Walk On) will be supplied with a vehicle for an agreed period of time allocated on booking. At no time will the vehicle belong to or become the property of the hirer.

  • The hirer agrees not to use the vehicle in violation of the law, nor remove the vehicle from England, Scotland or Wales unless authorised by Walk On, in writing. 

  • The hirer shall ensure that the vehicle is locked when unattended and that the keys are kept with them at all times. 

  • The hirer agrees to return the vehicle to Walk On in the same condition they received it.

  • No one other than the hirer named in the rental agreement may drive the vehicle.

  • The hirer will provide their permanent address and/or driver beyond reasonable doubt by providing their driving licence, two other means of identification (dated up to 90 days old) for each driver, and ensure that each driver is not excluded under the conditions provided in these terms & conditions. 

 

  • You and any other hirer of the vehicle must not: 

1. be used the vehicle for any illegal purpose, teaching someone to drive, use the vehicle under the influence of alcohol/drugs.

2. be used for anything other than the carriage of equines, and must be within the payload of the vehicle.



Your Responsibilities 

  • The hirer is responsible for the safety and welfare of all horses and it is the responsibilty of the hirer to make sure the horses are insured. The hirer accepts full responsibility for damage or injuries suffered by the hirer, horses, individuals or third party. 

  • The hirer is responsible for all damage to the vehicle by horses, individuals and third parties. The Hirer agrees that he/she is liable to pay the costs of repair to any damage caused by their livestock during the hire period.

  • The hirer is responsible for any loss or damage to the vehicle caused by negligence, misuse or otherwise, whether or not such loss or damage was caused by the hirer. The hirer will pay for costs of repair of any interior or exterior damage or loss to the vehicle or its equipment.

  • The hirer shall not sell, assign, lend, let or hire the vehicle, remove any items from the vehicle, give possession of the vehicle to any individuals, nor attempt to remove or interfere with any identification marks or plates on the vehicle. The hirer must not grant anyone legal rights over the vehicle.

  • If the Hirer commits any breach of this agreement, Walk On may treat the agreement as terminated and may seize, without legal process, or notice to the Hirer, the vehicle at any time and place and the Hirer waives all claims for damages connected with such a seizure.

  • The Hirer authorises Walk On to verify through credit agencies, the Driver and Vehicle Licensing Agency or any other sources, personal, driving and credit information provided by the Hirer and any additional drivers overleaf.

  • The Hirer must look after the vehicle and the keys to it. The Hirer must always keep the vehicle locked securely at all times when unattended, ensuring use of all security device(s) fitted to or supplied with the vehicle. The Hirer agrees that in the event of theft he/she will be liable to pay an excess of a minimum of £750.

  • The Hirer must protect the vehicle against any adverse weather conditions, which may cause damage to the vehicle. In the event of ice or moderate snow we may make the decision to terminate the hire, this is for the safety of the hirer and vehicle. The deposit will be refunded or transferred onto another date.

  • The Hirer must ensure that he / she uses the correct fuel for the vehicle, which is pump DIESEL. And the vehicle is returned FULL,  Walk On requires a receipt for proof of purchase.

  • The Hirer must let Walk On know as soon as he / she becomes aware of any fault in or with the vehicle. The Hirer must not let anyone work on the vehicle without the permission of Walk On. 

  • The hirer must return the vehicle to the Return Point on the Return Date. Until the vehicle is safely returned to Walk On the Hirer will remain responsible for the vehicle. The Representative of Walk On must inspect the vehicle before it is handed back to them so that they can ensure that they are satisfied with the condition in which it has been returned. 

  • Before the Hirer returns the vehicle he / she must ensure that no personal belongings are left in the vehicle. Walk On is under no obligation to return any such belongings left by the Hirer. 

  • The vehicle is not designed to carry more than the overall weight of 3.5T and hirer must make sure they do not overload the Vehicle. Knowing your horses weight will help with this, everything you put inside the horsebox (including yourself as a driver) will add weight to the horsebox so total payload does not mean it can be maxed out with 'horse weight'. Walk On is not responsible for overloading. Should the vehicle be confiscated due to overloading, all fines, charges & lost revenue will be charged to the Hirer. 

  •  It is the sole responsibility of the Hirer to ensure that horses travel with passports at ALL times. If you breakdown, roadside recovery will not move your horse if you do not have the passport present. 

 

Rental Damage Deposit 

  • The condition of the vehicle upon its return will be compared against the condition of the vehicle upon its pick up by reference to the difference, if any, seen in the walk around video & condition form. Provided the vehicle is returned to the Return Point on the Return Date in the same condition as at the Pick Up Date with a clean interior and there are no other extra charges, the £500 rental damage deposit will be returned in full.

  • Should the vehicle be returned in a worse condition than at the Pickup Date, then repairs, replacement or cleaning costs will be charged & the deposit will not be returned & depending on damage, a cost will be charged.

  • The following surcharges may be charged to the Hirer after returning the vehicle and deducted from the damage deposit. Published rates must be paid on the day of hire to Walk On.

1. Excessively dirty interior or exterior: £50 (no pets allowed in the cab); Complete Ban on smoking if not adhered to: £50 ; Low fuel: £25 charge plus the fuel cost

2. Any driving offences committed whilst the vehicle is on hire will be the responsibility of the hirer i.e. the person who signed the documentation for terms and conditions and whose license has been sent to Walk On. The Hirer must pay any and all fines and costs (including court costs) incurred for parking, traffic, congestion charges or other offences, (including any costs which arise if the vehicle is clamped). The Hirer must pay to the appropriate authority any fines and costs if and when the authority demands this payment. If not, the hirer will be responsible for paying any costs and reasonable administration charges incurred by Walk On in dealing with these matters. Any fines incurred and not apparent until a later date will be forwarded to the hirer (such as speeding tickets).

3. The Hirer is liable for any charges arising from HMRC or Immigration Authorities seizing the vehicle, together with a loss of income charge for the full period during which the Owner cannot rent out the vehicle as a consequence. 

 

  •  Interest will be added every day to any amount not paid on time.

  • The Hirer must pay the Daily Rate for everyday there is failure to return the vehicle to the Return Point 8am-6pm. An hourly late fee will be charged at £25 per hour.

Pick-up and Return 

  • The vehicle will be available for pick up from the Pickup Location on the Pickup Date and must be returned to the Return Point by appointment, on the Return Date. Any delay in returning the vehicle will result in the hirer being charged the Hourly Rate for each day which the hirer fails to return the vehicle to the Return Point. No refund is given for an early return of the vehicle. 8am-6pm is classed as a full day. 

  • Every effort is made to ensure that the vehicle reserved is available. If, due to circumstances beyond Walk On's control, which could not reasonably have been foreseen or avoided at any point up until the pick up date, the deposit will be refunded. Walk On cannot accept responsibility or pay any compensation, costs or expenses where the performance of the Rental Contract Walk On is prevented or affected or you otherwise suffer any loss or damage as a result of events beyond Walk On’s reasonable control.

The horsebox will not be hired to or driven by: 

  • a)  Persons under 23 or over 75 years of age

  • b)  Persons that have held a UK or EU driving licence for less than two years

  • c)  Persons that have less than two years recent driving experience of a motor vehicle in the United Kingdom

  • d)  Persons that have been convicted of an offence in connection with the driving of a motor vehicle or motorcycle and/or
    have had their driving licence suspended or endorsed with more than 6 penalty points within 5 years of the date of them driving

  • e)  Persons with a disability or medical condition that must be notified to the DVLA, unless the DVLA have in been notified and a current driving licence valid for the vehicle being driven is held

  • f)  Persons that have had an insurance declined and/or renewal refused and/or any other special terms imposed and/or have had an insurance policy cancelled by an insurer

  • g)  Persons who have been involved in more than one fault, or two non-fault motor accidents/thefts/claims in the last three years

  • h)  Persons engaged in any of the following occupations or professions:- 

  • Professional entertainment or theatrics

  • Undergraduates or students age under 25 years

  • Foreign Services personnel born outside of the United Kingdom 

Suitable Persons 

We will only provide cover for hirers that have: 

  • fully completed and signed a hirer proposal form immediately prior to the hire, or

  • fully completed and signed a hirer proposal form within 12 months of the date of the hire AND completed a repeat hire
    slip form immediately prior to the hire. The hirer's proposal form and repeat hire slip (if applicable).

  • Use of the vehicle is restricted to social, domestic and pleasure purposes and the business of the driver or hirer (excluding the carriage of passengers for hire and reward). Carriage of Goods for Hire & Reward is only permitted if your Certificate of Insurance permits so. The only type of goods that may be carried for Hire & Reward are Horses and ancillary equestrian equipment.
    Carriage of goods of an explosive, dangerous or hazardous nature is excluded. Private Hire is excluded. 

  • Walk On  reserves the right to refuse to hand over a vehicle to any person who, in the reasonable opinion of Walk On, is not suitable to take charge of the vehicle. In such cases of refusal, all payments made by the Hirer will be refunded in full, but Walk On will not have any further liability in relation to the aborted hire, nor to the person to whom hire was refused. 

  • Walk On reserves the right to cancel the hire if at Pick Up Date or at any time during the Rental Term it becomes apparent that any of the drivers’ licence(s) are invalid or not in accordance with the Hirer’s Profile. In these circumstances all payments made by the Hirer will be forfeited. 

 

Breakdown 

  • The horsebox is covered with Equine Rescue Services who will provide cover for the horsebox if it breaks down and will send alternative transport for your horse. 

  • However the hirer will bear all costs of breakdown or repair in circumstances where the incident is the result of negligence on his/ her part, for example by running out of fuel, filling a tank with the wrong fuel, locking keys inside the vehicle or losing keys. 

 

Accident 

  • No responsibility is or can be accepted by Walk On for any loss or damage or expense which occurs as a result of any accident. Upon demand The Hirer shall fully indemnify Walk On against all losses, liabilities, costs, actions, claims or demands which Walk On may incur in relation to the vehicle and / or horses and / or use of the vehicle which are not recoverable by Walk On through our insurance policy. 

  • In the case of an accident: 

1. The hirer shall notify Walk On immediately in the event of an accident and also inform the police

2. The Hirer must ensure that he / she takes all details of the incident including photographs of all vehicles involved; names and contact details of all people involved and make, model and registration numbers of all vehicles involved. 

3. The Hirer shall not admit liability to any person in relation to such accident

4 .The Hirer shall forward all documents relating to all proceedings stemming from and in connection with the incident to Walk On

Endorsement for Anthony D Evans Horsebox Self Drive Hire 

Non-disclosure cover – Self Drive Hire 

A pre hire Insurance questionnaire must be completed by all hirers and held by the policyholder to be produced to the Insurer when requested. The form must be completed and signed prior to each hire. 

 

25% Contribution for Theft or Attempted Theft 

In the event of a claim under Section 1 — Damage to or loss of vehicle, by means of theft or attempted theft, failing to return the insured vehicle, conversion to sale, or taking your vehicle away without Walk On's permission the hirer shall contribute an amount of 25% for each claim. The contribution shall be no less than £750.

Pre and Post Hire Inspections 

Excluding Cash Hires in Full and Deposits 

Deposits must be taken via Bank Transfer before the hire commences, the deposit amount taken will be £200 and returned after the hire ends once the horsebox is returned in the same condition it left in. In the event of a claim the hirer is liable to pay the excess fee of £500 which must be transferred straight away to Walk On Equine Transport in the event of a claim.

We will not provide cover whilst the vehicle/s are let out on hire where the hire fee is paid in cash. Bank transfers only.

Accidents/Convictions 

Two minor motoring convictions (CU10-60, MS10-30, MW, PC, SP, TS, LC) allowed, more on referral Any fault claims within 5 years (inc. fire/theft) is on referral
One non fault claim within 5 years OK, more is on referral

Windscreen Excess 

Windscreen Excess for Replacement is increased from £100 as stated in Section 2 Windscreen Damage, to £250.00 

 

Please note: 

In the event of a claim, an up to date and signed hirer questionnaire must be available for inspection. In the event this is not provided, the insurer can refuse to settle the claim.

Disclosure Information

If the hirer breaks the Motor Rental Agreement, Walk On will make available the information the hirer have provided to us to credit reference agencies, the Driver and Vehicle Licensing Authority (DVLA), debt collectors and any other relevant organisations. We are also entitled to pass this information on to the British Vehicle Rental and Leasing Association (BVRLA), who in turn can pass it on to any of its members for any purpose stated in the Data Protection Act 1998. 

Ending the Rental Contract 

Walk On is entitled unilaterally to terminate immediately the Rental Contract by notice in writing to the hirer if:

  • The hirer fail to remedy any breach having been requested to do so by Walk On

  • The hirer is made bankrupt

  • If  Walk On end the Rental Contract it will not affect Walk On’s right to receive any money owed under the Rental Contract, including under these Terms. At any time after Walk On has terminated the Rental Contract in accordance with this clause or if the hirer fail to return the vehicle upon the Return Date, Walk On is entitled to repossess the vehicle and charge the hirer for doing so. 

General 

  • These Terms, Rental Schedule and the Reservation Details set out the entire agreement relating to the rental of the vehicle. 

  • These Terms are not intended to nor do they confer any right or entitlement on any third party whether under the Contract (Rights of Third Parties) Act 1999 or otherwise. 

  • Jurisdiction 

  • English Law governs these terms in all respects and you submit to the jurisdiction of the English Courts.
